Legal Warranties and Obligations

At OKKO, the sale of heavy truck parts is governed by applicable laws in Québec, including the Consumer Protection Act and the Right to Repair Act (Law 29). The following provisions apply to all our sales, even if we do not perform installation.

1. Mandatory legal warranties

Under sections 37 to 53 of the Consumer Protection Act, the following warranties apply automatically and free of charge:

  • Normal Use Warranty: The part must serve the purpose for which it was intended.
  • Reasonable Lifespan Warranty: The part must function for a reasonable period, considering its price, type, and usage conditions.
  • Hidden Defects Warranty: The part must not have a significant defect existing before the sale, undisclosed and undetectable by a prudent buyer.
  • Compliance Warranty: The part must match the description and representations made in our communications (contract, advertising, etc.).

2. OKKO commercial warranty

In addition to legal warranties, OKKO offers a commercial warranty:

Duration: 1 year from the installation date or 18 months from the purchase date, whichever comes first.

This warranty covers manufacturing defects and applies only if the part is used according to the manufacturer’s recommendations.

3. Availability of parts and information (Law 29)

OKKO undertakes to:

  • Make replacement parts and repair services available for a reasonable time after sale.
  • Provide necessary information for maintenance or repair, including technical data and required software.
  • Ensure parts can be installed with common tools without causing irreversible damage.

These obligations may only be excluded if OKKO informs you in writing before the sale.

4. Enforcement of warranties

In case of a defect covered by a legal warranty: OKKO may replace, or refund the defective part, and, where applicable, compensate for damages suffered in accordance with the law.

5. Limits and exclusions

Legal warranties apply even if the part is installed by you or a third party.

No clause can exclude or limit these legal warranties. Any mention such as “sold as is” or “without warranty” is null and void.
